外资准入负面清单 negative lists for foreign investment

　　国家发展改革委、商务部12月27日对外发布《外商投资准入特别管理措施（负面清单）（2021年版）》和《自由贸易试验区外商投资准入特别管理措施（负面清单）（2021年版）》，自2022年1月1日起施行。这是我国连续第五年缩减全国和自贸试验区负面清单。

　　The National Development and Reform Commission and the Ministry of Commerce on December 27 unveiled the Special Administrative Measures on Access to Foreign Investment (2021 Edition) and the Free Trade Zone Special Administrative Measures on Access to Foreign Investment (2021 Edition), both of which will take effect on January 1, 2022. This marks the fifth consecutive year that China has shortened its national negative list and pilot free trade zone (FTZ) negative list.

　　外资准入负面清单是我国实行准入前国民待遇加负面清单管理制度的根本依据。负面清单以外的外商投资，按照内外资一致原则管理，给予国民待遇。各地区、各部门不得在负面清单之外的领域单独针对外资设置准入限制。

　　2017年至2020年，我国连续四年修订全国和自贸试验区负面清单，外资准入特别管理措施分别由93项、122项减至33项、30项。2021年版全国和自贸试验区外资准入负面清单，进一步缩减至31条、27条。此次缩减进一步深化制造业开放，在自贸试验区探索放宽服务业准入，并提高外资准入负面清单精准度，优化外资准入负面清单管理。

　　【重要讲话】

　　中国已批准《区域全面经济伙伴关系协定》，并申请加入《全面与进步跨太平洋伙伴关系协定》，将在履约和谈判进程中继续压减外资准入负面清单，推动农业和制造业全方位开放，加大服务业开放力度，依法给予内外资企业同等待遇。

　　China has ratified the Regional Comprehensive Economic Partnership (RCEP), and it has applied for joining the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP). In the course of RCEP implementation and CPTPP negotiation, China will continue to shorten the negative list on foreign investment, promote all-round opening-up of its agricultural and manufacturing sectors, expand the opening of the service sector, and treat domestic and foreign businesses as equals in accordance with law.
